Taxi 15-Year-Age Limit Legal Challenge, As many drivers are aware, early in 2010 we attempted to raise a fighting fund to challenge the decision to impose a 15 year age limit on London taxis. Unfortunately, we could only raise £4000 of which nearly half that was spent on seeking counsels opinion. We did have a good chance of winning but money was the problem. We then went for a second opinion on the grounds of Age Discrimination as the most badly affected drivers will be those that work part time to supplement their pensions. This could have been done before an Employment Appeals Tribunal. The law is that if an authority makes a decision that puts people out of work they can appeal to the Tribunal. The opposition cannot claim any costs if they lose and the appellant could claim up to £20k. Unfortunately, TfL would not stand back and let this go as they would have to cancel the age limit decision. They could then appeal this to the High Court and as far as the European Court of Justice. This would have cost many thousands of pounds, which was out of our reach. Due to those financial constraints, we have had to call it a day. We spent over £2k on counsels’ opinion and any driver who requires a refund will only be fully entitled to half of their contribution. So please contact us to get back some of your money. If you do not require a refund we will donate funds to a trade charity. Further Taxi Drivers & Owners Legal Protection would like to thank those drivers and garages who donated money to the cause.
